Users’ Terms of Service

Use of this website, the materials presented on it, and the services provided by DestinationBnB are subject to the following terms and conditions “Terms”. By using this site, you agree to be legally bound by these Terms and acknowledge reading them.

Users’ Terms of Service

The DestinationBnB platform offers an online venue that enables its registered users to publish, offer, search for, and book lodging and concierge services. Members who publish and offer services are “Hosts” and members who search for, book, or use concierge services are “Guests.” Hosts offer accommodations. Concierge and other services are offered and managed by DestinationBnB. You must register an account with us to access and use many features of DestinationBnB and must maintain your account information with current data. As the provider of the DestinationBnB website, DestinationBnB does not own, control or manage any listings set out therein. DestinationBnB only controls and manages the concierge services. DestinationBnB is not a party to any contract entered into directly between Hosts and Guests, nor is DestinationBnB a real estate broker, insurer, or property management company. DestinationBnB is not acting as an agent in any capacity for any Member except as specified in the payment terms. Nothing in these Terms shall be interpreted to deem the relationship between DestinationBnB and its Guests and/or Hosts as a joint venture, agency, or partnership.

Guest Responsibilities

Guests are responsible and liable for their acts and omissions and those of their guests, invitees, and any other people on the premises during Guests’ rental. Guests agree to act with integrity, treat all others, including neighbors, with respect and comply with all applicable laws. Guests also agree to leave the premises in the same conditions as when they checked in, reasonable wear and tear excepted.

Host Responsibilities

Hosts agree to the following:
• They have the capability to accept rental bookings for the Host premises they represent and have listed on our site.
• They appoint DestinationBnB as an agent to book the premises they have listed for rent on the DestinationBnB website.
• Any resulting contract for a rental is between the Host and the Guest; DestinationBnB is not a party to such contracts.
• The information they provide about any premises they have listed for rent on the DestinationBnB site is correct and the description is truthful.
• They accept DestinationBnB’s privacy policy in its entirety.
• They shall be paid two days after completion of the rental. This provision ensures that there were no issues with the rental and no refunds were requested by the Guest.
• DestinationBnB is a payment facilitator, not a property manager.
• They will act towards Guests in a way that complies with all laws, rules, and regulations pertaining to the premises.

What Constitutes a Reservation or Order?

When Guests reserve a host property, they are confirming their limited ability to enter and occupy the premises. Should the Host request, Guests agree that they have the ability to enter the premises during the day and at an agreeable time. When Guest reservation time has ended, Guests agree to exit the premises. If Guests do not leave the premises as contracted, they agree to allow the Host to remove them in a manner consistent with applicable law. Guests may only allow the number of guests and invitees to stay overnight that are approved in the provisions of their booking agreement. Guests may not have an event or party with more than the agreed number of guests or invitees unless agreed in advance in their booking agreement. Any modification of a booked reservation will be handled between the Host and Guest.

What If I Need to Cancel My Reservation?

Any cancellation and refund will be determined by the following Cancellation Policy:

5 Days’ Notice or More – Free cancellation and refund of all fees if DestinationBnB is notified by email by 5 days before their designated check-in time.

Fewer Than 5 Days’ Notice – Cancellations with fewer than 5-days’ notice before Guest check-in time will receive a full refund, less one night’s stay and the service fee (10%) of the total booking and cleaning fee.

If Guest Decides to Leave Early – No refund will be given unless otherwise arranged with the Host. If the Guest has an emergency or perceives a cleanliness issue, the Guest should contact us and we will work to resolve the issue to the best of our ability. If you are not sure what to do in a particular circumstance, please call us at 866-265-0995 and you will be connected with a live agent. We are a small company and committed to your vacationing better with us.

Adherence to Laws

Guests and Hosts are each responsible for their respective adherence to all federal, state, and local laws and regulations regarding the subject matter hereof.

Intellectual Property

Unless otherwise noted, all materials, including but not limited to text, images, illustrations, designs, icons, photographs, video clips, software, and written and other materials that are part of this website are protected under copyright laws and are the trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by DestinationBnB.

Privacy

DestinationBnB is the sole owner of the information contained on this site. We do not collect your information except to the extent you voluntarily share your information with us via email or other direct contact from you. We will not sell, trade, or rent this information to anyone for any reason, ever. We will use your information to respond to you regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to provide you the services you request from us. We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (e.g, billing or customer service) are granted access to personally identifiable information. The computers/servers on which we store personally identifiable information are kept in a secure environment.

No Warranty

The information presented on this website is provided “as is” without representation or warranty of any kind as to suitability, reliability, applicability, merchantability, fitness, noninfringement, result, outcome or any other matter. Any representation or warranty that might be otherwise implied is expressly disclaimed. Guests and Hosts agree that we are not liable to them or others, in any way or for any damages of any kind or under any theory, arising from this website, or their access to or use of or reliance on the information in or through this site, including but not limited to liability or damages under contract or tort theories or any damages, regardless of prior notice to us.

Limitation of Liability

Guests and Hosts release, waive, discharge, hold harmless, indemnify, and defend DestinationBnB and its employees, directors, officers, shareholders, agents, and representatives, from any and all liability, damages, and causes of action of every nature relating in any way to these Terms or DestinationBnB’s performance of its services thereunder.

Miscellaneous

Severability: If any provision of these Terms is held illegal, unenforceable or invalid, the legality, enforceability, and validity of the other provisions shall not be affected or impaired.
Integration: Hosts, Guests and DestinationBnB agree these Terms represent their entire understanding regarding the subject matter hereof, and that they supersede any prior agreements or representations, whether oral or in writing.
Modifications: DestinationBnB reserves the right, at our sole discretion, to change, modify, add or remove portions of these Terms at any time. Accordingly, DestinationBnB recommends that you revisit this site from time to time to ensure that you are aware of our current terms. Your continued use of the website following any changes signifies your acceptance of these changes.
Disputes and Attorneys’ Fees: Any dispute arising out of these Terms shall be fully and finally settled by binding arbitration by a single arbitrator with Judicate West or JAMS. Judgment on any award rendered by the arbitrator may be entered and enforced in any court having jurisdiction. The prevailing party at arbitration shall be entitled to its attorneys’ fees.
Venue & Governing Law: You and DestinationBnB agree that these Terms shall be governed by the laws of California without regard to its choice of law provisions, and that venue of any action or arbitration shall be in Riverside County, California.
Binding Successors and Assigns: All of the terms and conditions of these Terms shall be binding upon and inure to the benefit of the parties hereto and to their respective heirs, successors, and assigns.
